Terms and conditions

The website www.dedelftseblik.nl, incl. the English-language version, (hereafter: the platform) is a project of the Museum Prinsenhof Delft.

  2. Applicability

    These Terms and Conditions apply to all visitors to the platform www.dedelftseblik.nl who want to submit a contribution (hereafter: User(s)). They explain, among other things, how to submit a contribution and what to keep in mind when doing so. Please read them carefully. By submitting a contribution, you agree to the Terms and Conditions and are bound by them. The Terms and Conditions can be consulted digitally on the platform. The Museum Prinsenhof Delft will also send you a copy of the Terms and Conditions free of charge by post, on request. Send your request to: dedelftseblik@delft.nl
  3. Submissions

    If you wish to submit a contribution, you can do so using the form at www.dedelftseblik.nl. You can send a written text, PDF or audio recording, and add an image or description to you submission if you wish. It is also possible to send files via WeTransfer or other file-sharing system. Users under 16 years of age need written permission of their parent or guardian to send in a contribution. As User, you are responsible for the contribution you submit.
  4. Content of your contribution

    Be careful about your contribution. Make sure your contribution does not violate the rights of others and meets the Rules and these Terms and Conditions. You are not, for example, allowed to submit images, videos or personal data of third parties that might violate the image rights or copyright of third parties without them having given their explicit permission. For third parties who are underage, the written permission of the parents or legal representative(s) is required.

    With respect to content, contributions must always fit within the framework of the project De Delftse Blik (The Delft Perspective). In addition, your contribution must not contain any material (such as photographs, written texts and videos) that:

    -discriminates on the basis of appearance, race, religion, gender, culture, origin or is in any other way hurtful;
    -is offensive or violent and/or incites hatred;
    -is inaccurate or misleading;
    -is pornographic in nature;
    -contains confidential information or private data concerning third parties;
    -violates the (intellectual property) rights of others, including copyrights, trademark rights and design rights;
    -violates the image rights of third parties;
    -contains viruses, Trojan horses, worms etc. or other software that can be harmful;
    -contains spam, chain letters, junk mail, unsolicited emails, offers or advertisements of any sort;
    -contains links to websites with unlawful content;
    -is contrary to public order and/or any legal regulation;
    -is contrary to standards of decency and good taste;
    -is contrary to these Terms and Conditions.

    The Museum Prinsenhof Delft reserves the right to refuse, edit or remove material submitted or published by the User. In such cases, the Museum Prinsenhof Delft does not accept any responsibility. The Museum Prinsenhof Delft is not required to inform the User concerning this.
  5. Copyrights (and other rights to intellectual property)

    The copyrights and/or other rights to intellectual property you have to your contribution remain yours. By submitting a contribution, you grant the Museum Prinsenhof Delft permission (license), with respect to (parts of) your contribution:
  • To use it on the website www.dedelftseblik.nl as part of a digital presentation we may compile there;
  • To use it on the general website of the Museum Prinsenhof Delft, www.prinsenhof-delft.nl.

You also grant permission to the Museum Prinsenhof Delft, with respect to (parts of) the contribution you submit:

to include it in the (digital) collection of the Museum Prinsenhof Delft and to use it for future digital and physical exhibitions;

to use it and make it available in presentations and press material to promote the components mentioned in point V (the websites mentioned, digital and physical exhibitions, as part of the collections etc.);

to publish it on the public social media accounts of the Museum Prinsenhof Delft. Your contribution will be visible to everyone and can be shared by users of these social media.
If there are rights (copyrights and/or other rights to intellectual property) to your contribution that do not belong to you but to a third party, you guarantee that you have received the permission of the relevant third party to submit the contribution and grant the (sub)licenses mentioned above by accepting the Terms and Conditions

6. Indemnity
You indemnify the Museum Prinsenhof Delft against possible claims by third parties as a result of or arising from the use of your contribution as described above, including but not exclusively against claims on the basis of copyrights, rights to intellectual property, image rights or privacy rights, slander, libel and/or (arising from) violations of the provisions of these Terms and Conditions.

7. Liability
The Museum Prinsenhof Delft can, at any given time, modify, improve or (temporarily) shut down the platform www.dedelftseblik.nl. You accept that the Museum Prinsenhof Delft cannot guarantee the platform will always work properly. The Museum Prinsenhof Delft accepts no responsibility in this regard. The Museum Prinsenhof Delft accepts no responsibility for damage due to viruses, the loss of contributions or, for example, the fact that the platform (temporarily) does not work properly.
The Museum Prinsenhof Delft disclaims any responsibility for contributions with respect to you as User and/or with respect to third parties. The Museum Prinsenhof Delft accepts no responsibility for damages of any nature arising from or associated with the use of (content on) the platform or links to websites of third parties on the platform or other technical facilities. A link to the website of a third party does not imply the Museum Prinsenhof Delft is associated with this third party or the Museum Prinsenhof Delft endorses the content of the relevant website. The limitations to liability mentioned in these Terms and Conditions are, with respect to the relevant party, not applicable in case of intent or of gross negligence on the part of the Museum Prinsenhof Delft.

8. Privacy
In the context of (submitting) a contribution and granting permission to the Museum Prinsenhof Delft via an online form, you provide certain personal data. The Museum Prinsenhof Delft processes this personal data in conformity with the Algemene Verordening Gegevensbescherming (AVG) (General Data Protection Regulation, or GDPR) and its policy on privacy. 9. Various provisions
The Museum Prinsenhof Delft reserves the right to modify these Terms and Conditions from time to time, unilaterally. The most recent version can always be consulted on the platform. The headings above the texts in these Terms and Conditions are only intended to enhance readability and are not part of the Terms and Conditions. If one or more provisions are wholly or partially void or voided, the other provisions of these Terms and Conditions will remain fully applicable.

10. Dutch law and choice of forum
All legal relationships to which the Museum Prinsenhof Delft is a party are exclusively governed by Dutch law, even if an agreement is wholly or partially carried out abroad or if the party involved in the legal relationship is domiciled there. Unless mandatory law prescribes otherwise, disputes relating to and arising from (the use of) the platform and your contribution will be submitted exclusively to the competent court in The Hague.
